FAQs

Within 30 days of receiving your complaint, SCRT will send you a letter acknowledging receipt of the complaint.

Upon receipt, the complaint is forwarded to the SCRT Professional Conduct Committee (PCC) to be reviewed and investigated. Please note that the investigation process can take several months.

Once the PCC completes its investigation, it must determine whether the RRT’s conduct falls within the definition of professional misconduct and/or professional incompetence as set out in the Act.

If the PCC considers the conduct does not constitute professional misconduct and/or professional incompetence as set out in the Act, the PCC will dismiss the complaint.

SCRT must inform the RRT member that a complaint has been made against him or her and provide the RRT with a copy of the complaint. The RRT will be advised that they have the right to respond to the SCRT Professional Conduct Committee (PCC) regarding the complaint. In most cases this response will be shared with the complainant and the complainant may be asked to comment.

The complainant may also be asked to consent to the release of any further relevant documentation for the PCC’s investigation. It is not uncommon for the PCC to request a more formal and detailed investigation in order to obtain additional information. In this case an investigator, appointed by the Registrar, will investigate the complaint. This may include interviewing witnesses, obtaining medical records and other documents, and speaking with co-workers and employers.

If the SCRT Professional Conduct Committee (PCC) considers the conduct likely constitutes professional misconduct and/or professional incompetence, then the RRT’s conduct must be addressed to ensure public safety. There are two ways that this can be accomplished.

The PCC may enter an agreement (Alternative Dispute Resolution - ADR) with the RRT under which the RRT acknowledges the problem with his or her conduct and agrees to complete the remedial measures by a certain date, as specified by the PCC.

If such an agreement is not reached, then the matter is referred to the Discipline Committee (DC) to conduct a hearing.
